Florida Medicaid Third Party
Liability Recovery Program
The Agency for Health Care Administration (AHCA) has contracted with Health Management Systems, Inc. (HMS) to identify, manage, and recover all Florida Medicaid paid funds when a Florida Medicaid recipient is involved in a tort or casualty accident/incident. In this capacity, HMS is also responsible for additional services on behalf of AHCA including:
- Estate Recovery
- Trust & Annuities
- Medicare & Other 3rd Parties
- Cost Avoidance
- The HIPP Program
There are a variety of Florida Statutes and Federal Acts that grant the authority to the Agency for Health Care Administration and their contractors to recover all applicable funds paid on behalf of Medicaid Recipients when another party is or was responsible.
They are:
- Health Insurance Portability and Accountability Act (HIPAA)
- Florida Statutes Section 409.910 “Medicaid Third-Party Liability Act”
- Florida Statutes Sections 409.901 and 409.910
- Florida Statutes Section 409.9101
- Florida Statutes Section 733.2121(3) (d)
